Switzerland has been religiously divided along cantonal lines since the Reformation, when Zwingli preached in Zurich and Calvin governed Geneva while the forest cantons stayed Catholic. The 1847 Sonderbund war between Catholic and Protestant cantons was the last armed conflict on Swiss soil and shaped the federal settlement that followed. Church and state remain a cantonal matter rather than a federal one, so recognition, church taxes and religious instruction differ from one canton to the next. Catholics and the Reformed church were roughly equal for most of the twentieth century; both have declined sharply since the 1970s, and the religiously unaffiliated are now the largest single group. A Muslim minority of around 5 per cent, largely of Balkan and Turkish origin, became the focus of a 2009 referendum banning new minaret construction.

Article 3 of the federal Constitution reserves to the 26 cantons the power to levy church tax on members of churches each canton recognizes under public law, ordinarily among the Roman Catholic, Evangelical Reformed, Christian Catholic and Jewish communities. Recognition, rates and whether businesses also owe the tax all vary by canton; four cantons, Geneva, Neuchatel, Ticino and Vaud, levy no church tax at all, while among the rest a comparable liability can run from about 332 Swiss francs in Valais to about 2,213 francs in St Gallen. 4

Apostasy or Blasphemy Law

Article 261 of the Swiss Criminal Code, attack on the freedom of faith and the freedom to worship, punishes anyone who publicly and maliciously insults or mocks the religious convictions of others, including belief in God, or maliciously desecrates an object of religious veneration, with a monetary penalty of up to 180 daily units. More than 150 people have been prosecuted under the article since 1960, and the Swiss parliament voted 115 to 48 in November 2020 against a motion to repeal it. 3

Recognition happens canton by canton rather than nationally: most cantons grant public law status, and with it the right to levy a church tax on their own members through the ordinary tax system, to one or more of four communities, Roman Catholic, Christian Catholic, Protestant or Jewish, while the cantons of Geneva, Neuchatel, Ticino and Vaud recognize none of them this way and do not levy the tax at all. A community outside this public law recognition organizes instead as an ordinary nonprofit association and applies separately to its own canton for tax exempt status. 3

Religion and History in Switzerland

Switzerland is one of the places where the Reformation happened rather than one of the places it arrived. Huldrych Zwingli began preaching at the Grossmunster in Zurich in 1519 and pushed further than Luther on the Eucharist and on images, and the two men failed to agree at Marburg in 1529, a split that has divided Protestantism ever since. A generation later John Calvin turned Geneva into a working model of a reformed city, and the academy he founded there trained the preachers who carried Calvinism to France, Scotland, the Netherlands and Hungary.

Anabaptism also emerged in Zurich, among Zwingli's own followers who concluded that infant baptism had no warrant, and was persecuted by Protestant and Catholic authorities alike; the Swiss Brethren and later the Amish trace to that movement. The forest cantons of the interior stayed Catholic and defended that choice by arms, and the confessional map that resulted has proved remarkably stable. Because the cantons rather than the confederation held religious authority, Switzerland never produced a single national settlement, and it still has not: church tax, recognition and religious instruction remain cantonal questions answered twenty six different ways. Both historic churches have lost members steeply since the 1970s, and the largest single group in the country now reports no religious affiliation at all.

The Minaret Ban and Cantonal Church Arrangements

In November 2009 Swiss voters approved a popular initiative inserting into the federal constitution a prohibition on building new minarets. It passed with about 57 per cent of the vote against the recommendation of the federal government, parliament and the major churches, and it applied to a country that then had four minarets in total. The vote is instructive about the Swiss system rather than only about Islam: a constitutional amendment can be placed on the ballot by collecting signatures, so a measure that no institution supports can still become fundamental law.

The provision has been criticised by the European Commission against Racism and Intolerance and has never been tested at the European Court of Human Rights, because applications brought immediately after the vote were declared inadmissible for want of a victim who had actually been refused permission. Everything else in Swiss religious law sits at cantonal level.

Most cantons recognise the Reformed and Catholic churches as bodies of public law and collect a church tax on their behalf, in several cantons from companies as well as individuals, which has been repeatedly challenged; Geneva and Neuchatel, shaped by a stricter separation, do not. Some cantons recognise the Christian Catholic Church and Jewish communities, and none has yet extended public law recognition to a Muslim body, which is the live question rather than the minaret clause.
